The firm is organized into four principal legal practice groups: insurance, appellate, employment law and tort litigation. Each of these practice groups brings the same principles and integrity, thoughtful analysis and dedicated representation to our clients.
The firm’s Insurance Practice Group is one of the largest practice groups of its kind in the state of Arizona and the Southwest. The Insurance Practice Group is anchored by four seasoned trial lawyers. The firm has a multi-state practice in this area representing an impressive list of well-known insurance companies. The nature and complexity of the matters handled ranges from simple automobile liability coverage questions up through complex commercial coverage litigation where million dollar and multi-million dollar exposures are common. Our coverage lawyers have a reputation for being “trial” lawyers who have successfully completed numerous jury trials as opposed to many of their counterparts in other firms who are “litigators” with little to no trial experience. Top law school graduates who possess substantial legal, analytic and writing skills are recruited for this practice group. Successful coverage practice requires superior skills in legal analysis and research and writing. Associates joining this practice group from the top of their law school classes enter a rigorous mentoring process involving multi-faceted policy architecture, formatting and interpretation. Many of the attorneys within this practice group have published in this field and maintain strong local, state and national reputations. The firm’s insurance practice group has a tradition of excellence in providing detailed and complex coverage analysis in a timely manner. Kunz, Plitt, Hyland & Demlong also has a vibrant defense practice representing insurance companies against claims for bad faith and punitive damages regarding property and casualty, life, accident, health, and disability claims. These types of claims arise from simple issues of delay, inadequate investigation and failure to pay issues. The practice group has also handled bad faith claims arising from the denial of complex property, business interruption, and directors and officers insurance coverage matters. These cases have been successfully defended through trial and appeal at both the state and federal court levels.
The firm’s Appellate Practice Group is seasoned. Each of the members of the Appellate Practice Group are top graduates from their respective law schools and each possess substantial skills in legal analysis, research and writing. The firm has long believed that handling appeals from trial court decisions is a distinct area that requires discrete skills exercised by outstanding attorneys. How appellate courts will view insurance coverage issues is critical, as is knowledge of developing areas of coverage and bad faith law. The skill in presenting written arguments – not always demanded in trial practice – is paramount on appeals. The attorneys within the Insurance Coverage and Bad Faith Litigation Practice Group and the Employment Practice Group have significant appellate experience which has resulted in a broad and successful overall appellate practice.
Our Employment Law Practice Group represents clients of all sizes and diverse industries, including the public sector. Our attorneys have considerable background providing counsel and litigating all aspects of employment related claims and issues including age, sex, religion, disability, equal pay, non-compete agreements, race, family medical leave, pregnancy, drug testing, retaliation, whistle blowing protection, and wrongful discharge. We bring substantial talent and significant industry experience to our handling employment related issues while maintaining a cost friendly rate structure that does not require the high rates charged by large law firms with similar specialized practice groups. The use of Kunz, Plitt, Hyland & Demlong as employment counsel by several leading insurance companies has substantially reduced the cost of their litigation in employment related matters while increasing the potential for positive results by using specialized employment counsel as opposed to standard insurance defense counsel who handle an occasional employment related matter. The firm also maintains a transactional employment practice from which employment practice programs are developed and maintained for the firm’s corporate and public sector clients.
The firm’s Tort Litigation Practice Group has a demonstrated ability to try cases before juries and judges. The Chairman of the Tort Litigation Practice Group is a member of the Arizona’s American Board of Trial Advocates and is certified by the Arizona State Bar Association as a specialist in Injury and wrongful death litigation. Attorneys in the firm have successfully tried product liability cases including complex and novel products liability matters involving automotive, chemical, pharmaceutical, manufacturing and consumer products. The firm’s insurance defense practice provides broad base representation of individuals, corporations and insurance companies in matters ranging from general negligence to consumer fraud. The Tort Litigation Practice Group specializes in complex injury cases including brain injury, catastrophic injury and wrongful death. The firm’s Tort Litigation Practice Group also represents professional malpractice claims involving doctors, lawyers, architects, engineers, and insurance agents.
